Terms of Service
Chapter 1. General Provisions
Article 1 (Purpose)
These Terms of Service are intended to define the rights, obligations, and responsibilities of TOTO Booking Co., Ltd. (hereinafter referred to as the “Company”) and its users in connection with the internet-related services (hereinafter referred to as the “Services”) provided through Monkeytravel (including http://www.monkeytravel.com and its subdomains), an online travel booking platform operated by the Company.
Article 2 (Definitions)
  • ① "Monkeytravel"refers to an online platform operated by the Company that enables users to purchase or book travel-related products and services provided by local travel service providers through electronic communication systems such as computers and networks
  • ② “User” refers to any member or non-member who accesses Monkeytravel and uses the Services provided by the Company in accordance with these Terms.
  • ③ “Member” refers to a person who has registered with the Company by providing personal information and is able to continuously use the Services provided by the Company.
  • ④ “Non-member” refers to a person who uses the Services provided by the Company without registering as a member.
  • ⑤ “Local Travel Service Provider” refers to accommodation providers, tour operators, golf operators, transportation providers, local attraction operators, ticket providers, and other businesses that provide travel-related services to users in overseas destinations.
  • ⑥ “Travel Products” refers to tangible or intangible travel-related products and services, including accommodations, tours, golf, transportation, and other related services provided by Local Travel Service Providers, for which the Company provides intermediary and booking assistance services through Monkeytravel.
Article 3 (Display, Explanation, and Amendment of Terms)
  • ① The Company shall display these Terms, the Company name, representative name, business address (including the address for handling consumer complaints), telephone number, fax number, email address, business registration number, mail-order business registration number, and the person responsible for personal information protection on the main page of Monkeytravel so that users can easily access such information. However, the contents of these Terms may also be made available through a linked page.
  • ② Before a user agrees to these Terms, the Company shall provide separate linked pages or pop-up windows for important matters such as cancellation policies and refund conditions to ensure that users fully understand such information.
  • ③ TThe Company may amend these Terms to the extent that such amendments do not violate applicable laws and regulations, including laws related to electronic commerce, consumer protection, electronic documents, electronic transactions, electronic signatures, information and communications networks, and door-to-door sales.
  • ④ If the Company amends these Terms, the effective date and reason for the amendment shall be clearly stated and announced together with the current Terms on the main page of Monkeytravel from at least seven (7) days prior to the effective date until the day before the effective date. However, if the amendment is unfavorable to users, the Company shall provide at least thirty (30) days’ prior notice. In such cases, the Company shall clearly compare the terms before and after the amendment so that users can easily understand the changes.
  • ⑤ Any amended Terms shall apply only to contracts entered into after the effective date of the amendment. Contracts concluded before the amendment shall remain subject to the previous Terms unless the user expressly requests to apply the amended Terms during the notice period and the Company agrees.
  • ⑥ Matters not specified in these Terms and the interpretation of these Terms shall be governed by applicable laws and regulations, including consumer protection laws related to electronic commerce, as well as customary business practices.
Chapter 2. Company Services
Article 4 (Provision and Modification of Services)
  • ① The Company provides the following services:
    • 1. Providing information on Travel Products offered by Travel Suppliers and facilitating bookings for such products
    • 2. Providing booking assistance services for Travel Products offered by Travel Suppliers
    • 3. Providing information on and selling products directly operated by the Company
    • 4. Providing an online platform and related services that enable users to independently purchase goods and services
    • 5. Providing contract facilitation and customer support services related to Travel Products
    • 6. Other services determined by the Company
  • ② Unless explicitly stated otherwise on Monkeytravel that a product is sold directly by the Company, all products displayed on Monkeytravel are Travel Products provided by Travel Suppliers, and the Company acts solely as an intermediary platform between users and such suppliers.
  • ③ If a contract for a Travel Product is formed through the intermediary services described in Paragraph ②, the contract is concluded directly between the Travel Supplier and the user. Responsibility related to such contracts shall be borne by the relevant Travel Supplier and the user.
  • ④ The Company is not obligated to compensate users for any price differences between Travel Products offered through Monkeytravel and identical or similar products offered by other companies or platforms.
Article 5 (Suspension of Services)
  • ① The Company may temporarily suspend the provision of Services due to maintenance, inspection, replacement, malfunction, or interruption of information and communication systems such as computers or networks.
  • ② If If the suspension of Services under Paragraph ① is caused by the Company’s intentional misconduct or negligence, the Company shall be liable for damages suffered by users or third parties as a result.
  • ③ If the Company is unable to continue providing Services due to business closure, discontinuation of operations, business restructuring, merger, or similar circumstances, the Company shall notify users in accordance with Article 8 and provide compensation based on the conditions previously announced on Monkeytravel. If compensation standards have not been separately announced, the Company shall compensate users with cash or equivalent value corresponding to mileage points, credits, or other benefits recognized by Monkeytravel.
Chapter 3. Membership
Article 6 (Membership Registration)
  • ① Users may apply for membership by completing the registration form designated by the Company and expressing their agreement to these Terms.
  • ② The Company shall register an applicant as a member unless any of the following applies:The applicant has previously lost membership pursuant to Article 7 Paragraph ③ of these Terms, unless at least three (3) years have passed since the loss of membership and the Company has approved re-registration.The application contains false information, omissions, or errors.The applicant does not agree to the Company’s investigation under Article 24 Paragraph ①.The Company determines that registering the applicant as a member would cause significant technical or operational difficulties
  • ③ The membership agreement shall become effective when the Company’s approval reaches the applicant.
  • ④ If there are any changes to the information submitted at the time of registration, the member shall promptly notify the Company of such changes by updating the member information or through other methods such as email.
Article 7 (Membership Withdrawal and Loss of Membership)
  • ① Members may request withdrawal from membership at any time, and the Company shall process such requests accordingly. If the withdrawal request is made through a method other than the membership withdrawal function on the Monkeytravel website, the Company may request that the member submit the request through the designated withdrawal function on the website.
  • ② TheThe Company may restrict or suspend a member’s membership if any of the following applies:The member provides false information or uses another person’s information during registration.The member fails to make payments related to bookings, Travel Products, or other obligations associated with the use of Monkeytravel by the due date.The member interferes with other users’ use of Monkeytravel or disrupts electronic commerce activities through unauthorized use of information or similar actions.The member transfers, leases, pledges, or otherwise grants rights related to the Service or contractual status with the Company to a third party.The member engages in acts prohibited by applicable laws, these Terms, or public order and morality while using the Services.The member clearly expresses refusal to cooperate with the Company’s investigation under Article 24 Paragraph ①.The member intentionally interferes with the Company’s business operations.
  • ③ The Company may terminate a member’s membership if the same violation is repeated two (2) or more times after restriction or suspension, or if the cause of the violation is not corrected within thirty (30) days.
  • ④ If the Company terminates a member’s membership, the member registration shall be canceled. In such cases, the Company shall notify the member and provide at least thirty (30) days for the member to submit an explanation before cancellation.
  • ⑤ If membership is terminated due to the reasons specified in Paragraph ②, the Company may retain the member’s personal information related to membership registration for up to three (3) years from the date of termination.
  • ⑥ If these Terms cease to apply due to membership withdrawal or termination, any Monkeytravel mileage points, credits, or rewards shall automatically expire and will not be restored upon re-registration.
Article 8 (Notice to Members)
  • ① The Company may provide notices to members via the email address submitted by the member.
  • ② For notices intended for multiple unspecified members, the Company may substitute individual notice by posting the notice on the Monkeytravel website for at least one (1) week.However, matters that significantly affect an individual member’s transactions shall be notified individually.
Chapter 4. Purchases and Bookings
Article 9 (Applications for Purchases and Bookings)
  • ① Users may apply for the purchase or booking of Travel Products on Monkeytravel through the following or similar procedures:
    • 1. Searching for and selecting Travel Products
    • 2. Entering information such as name, phone number, and email address (or mobile phone number)
    • 3. ConfirmationReviewing the terms and conditions applicable to each Travel Product, including cancellation policies based on the policies of hotels or Travel Suppliers, restrictions on cancellation rights, and any additional fees or charges related to optional services
    • 4. Agreeing to these Terms and the Company’s cancellation policies, and acknowledging the matters described in Subparagraph 3 (including by clicking a confirmation button)
    • 5. Submitting a booking request for the Travel Product and agreeing to the Company’s confirmation process
    • 6. Selecting a payment method
  • ② The Company shall not be responsible for any disadvantages or damages resulting from incorrect information entered by the user (including name, age, phone number, or email address) or from loss of tickets, vouchers, or booking confirmations caused by the user’s negligence.
Article 10 (Formation of Contract)
  • ① The Company shall accept a user’s application for the purchase or booking of Travel Products under Article 9 unless any of the following applies:
    • 1. The application contains false information, omissions, or errors
    • 2. A minor applies for the purchase or booking of Travel Products
    • 3. WhereThe user does not agree to the Company’s cancellation policies during the booking process described in Article 9 Paragraph ①
    • 4. The Company determines that accepting the application would cause significant technical or operational difficulties
    • 5. The application violates applicable laws, regulations, or government guidelines
  • ② The contract shall be deemed concluded when the Company’s confirmation notice under Article 13 Paragraph ① is delivered to the user and payment has been completed.
  • ③ The Company’s acceptance shall include information regarding confirmation of the user’s booking request, product availability, and any correction or cancellation of the booking request.
Article 11 (Special Provisions for Minors)
  • ① If a user who is a minor under the age of nineteen (19) uses the Services or enters into a purchase or booking contract, the minor must obtain consent from a parent or legal guardian in advance or receive ratification afterward, unless otherwise provided by applicable laws.
  • ② When entering into a contract with a minor, the Company shall notify the minor and the legal guardian that the contract may be canceled if consent from the legal guardian has not been obtained.
Article 12 (Payment Methods)
  • ① Payment for Travel Products purchased or booked through Monkeytravel may be made using one or more of the following methods:
    • 1. Online bank transfer, virtual account transfer, or real-time bank transfer
    • 2. Payment by prepaid card, debit card, credit card, or other card-based payment methods
    • 3. Direct payment to a Travel Supplier, subject to the Company’s prior approval
    • 4. Other payment methods provided by Monkeytravel
  • ② Users are responsible for the accuracy of payment information entered in connection with Paragraph ①. If payment is not completed within a reasonable period after submitting a booking request, the Company may cancel the relevant booking request.
  • ③ The Company may verify whether the user has lawful authority to use the selected payment method and may suspend the transaction or request supporting documentation if necessary.
  • ④ The Company shall not be liable for any damages incurred by the user as a result of measures taken under Paragraphs ② or ③.
Article 13 (Confirmation Notices, Booking Modifications, and Cancellations)
  • ① Monkeytravel’s cancellation policies follow the policies of the relevant hotel or Travel Supplier. Such policies are disclosed to users during the booking and payment process, and bookings cannot proceed unless the user agrees to them.
  • ② When payment for a Travel Product has been completed, Monkeytravel shall provide the user with a confirmation notice containing booking and payment details via email or SMS.
  • ③ A user who receives a confirmation notice may immediately request modification or cancellation of the booking request if there is any discrepancy in the submitted information.Monkeytravel shall process such requests without delay if the request is made before the applicable cancellation deadline specified for the relevant Travel Product. However, modifications or cancellations are not permitted after the cancellation deadline.In such cases, Monkeytravel may actively assist in coordinating with the hotel or Travel Supplier to minimize the user’s inconvenience or losses, but shall not be responsible for any final cancellation fees or penalties imposed by the supplier
  • ④ Refunds shall be processed in accordance with Article 15 regarding cancellation and withdrawal rights.
Article 14 (Modification and Cancellation of Purchases or Bookings)
  • ① When payment for a Travel Product has been completed, the Company shall provide the user with a confirmation notice containing booking and payment details via email or SMS.
  • ② A user who receives the confirmation notice may immediately request modification or cancellation of the booking request if there is any discrepancy in the submitted information. The Company shall process such requests without delay if they are submitted before the applicable cancellation deadline specified for the relevant Travel Product.
  • ③ If a booking request is modified or canceled at the user’s request under Paragraph ②, refunds shall be processed in accordance with Article 17 regarding cancellation and withdrawal rights.
  • ④ Users may not modify or cancel booking requests after the applicable cancellation deadline. The Company shall not be liable for any damages incurred by users as a result.
  • ⑤ If a user is unable to modify or cancel a booking request under Paragraph ④, the Company may, for the user’s convenience, assist in coordinating with Travel Suppliers to minimize the user’s inconvenience or losses.However, this shall not apply if the user expressly objects to such assistance by the Company.
Article 15 (Cancellation of Contract Due to Pricing Errors)
  • ① If the price of a Travel Product is incorrectly displayed due to the Company’s mistake or a system error, the Company may request that the user cancel the purchase or booking request even if the user has already completed payment.
  • ② IfIf the user refuses to cancel the purchase or booking request after receiving the request described in Paragraph ①, the Company may cancel the purchase or booking contract in accordance with Article 109 Paragraph ① of the Korean Civil Act regarding cancellation due to mistake.
  • ③ If a purchase or booking request is canceled under Paragraph ①, or if the contract is canceled under Paragraph ②, the Company shall only be responsible for refunding the payment or taking necessary measures for the refund in accordance with Article 16, except in special circumstances.
Article 16 (Provision of Booking Confirmations)
  • ① Unless otherwise specified for a Travel Product offered through Monkeytravel, the Company shall provide the user with a booking confirmation or voucher after the reservation and payment have been completed so that the user may use the relevant Travel Product without difficulty.
  • ② If the Company fails to provide the booking confirmation or voucher for a Travel Product purchased through Monkeytravel due to reasons attributable to the Company, the Company shall compensate the user for damages resulting from such failure.However, the Company shall not be liable in any of the following circumstances where there is no intentional misconduct or negligence by the Company:Events of force majeure such as natural disasters, war, or similar circumstancesInterruption or failure of telecommunication services provided by telecommunications providersDamages caused by errors in the user’s computer or deviceDamages caused by incorrect or incomplete personal information or email addresses provided by the userDamages caused by a Travel Supplier unilaterally discontinuing the relevant Travel Product without prior noticeOther circumstances equivalent to the foregoing.
Article 17 (Refunds)
The Company shall promptly notify the user of the reason and refund the payment within three (3) business days from the date payment was received, or take necessary measures for such refund, in any of the following cases:
  • 1. If the Travel Product booked or purchased by the user becomes unavailable or sold out
  • 2. If the user cancels the purchase or booking request under Article 14 Paragraph ①, or if the booking is canceled pursuant to Article 15 Paragraph ②
  • 3. If the Travel Supplier unilaterally discontinues the Travel Product without prior notice
Article 18 (Cancellation and Withdrawal)
  • ① A user who has entered into a contract with the Company regarding the purchase of a Travel Product may withdraw or cancel the booking within seven (7) days from the date the confirmation notice is received. However, if the applicable cancellation deadline has passed or the booking was made under non-refundable conditions, cancellation fees may apply in accordance with the Company’s refund policy.
  • ② Users may not cancel or exchange a Travel Product after the scheduled start date of use has passed following completion of the booking and payment.
  • ③ Users may not return or exchange goods in any of the following cases:If the goods are lost or damaged due to reasons attributable to the user (except where packaging is damaged solely for the purpose of checking the contents)If the value of the goods has significantly decreased due to use or partial consumption by the userIf the value of the goods has significantly decreased over time to the extent that resale is difficult.
  • ④ If the Company fails to clearly disclose restrictions on cancellation or withdrawal rights in advance in a manner easily accessible to users, such restrictions shall not apply.
  • ⑤ Notwithstanding Paragraphs ① and ②, if the contents of a Travel Product differ from the advertised information or are not performed in accordance with the contract, the user may request cancellation or withdrawal within three (3) months from the date of use of the Travel Product or within thirty (30) days from the date the user became aware of such issue.
Article 19 (Effect of Cancellation or Withdrawal)
  • ① If a refund is processed pursuant to Article 17, the Company shall refund the payment already received within three (3) business days after receiving the returned goods or confirmation of cancellation. If the Company delays the refund, the Company shall pay delay interest calculated in accordance with the delay interest rate publicly announced by the Fair Trade Commission.
  • ② If payment for a Travel Product was made using a credit card, electronic payment method, or similar payment method, the Company shall promptly request the relevant payment provider to suspend or cancel the payment charge.
  • ③ In the case of cancellation or withdrawal, the user shall bear any costs required for cancellation of the booking.However, if the Travel Product differs from the information displayed on Monkeytravel or is not provided in accordance with the contract, the Company shall bear such costs.
  • ④ If shipping or delivery fees were paid when receiving goods, the Company shall clearly indicate which party is responsible for such costs in the event of cancellation or withdrawal.
Chapter 5. Privacy Protection Policy
Article 20 (Protection of Personal Information)
  • ① When collecting users’ personal information, the Company shall collect only the minimum information necessary to provide the Services. When collecting personally identifiable information, the Company shall obtain the user’s consent.
  • ② The Company shall make reasonable efforts to protect users’ personal information in accordance with applicable laws and regulations, including laws related to information and communications networks and personal information protection.However, the Company’s privacy policy does not apply to external websites linked from Monkeytravel that are not operated by the Company.
  • ③ The Company shall not use personal information provided by users for purposes other than those specified in these Terms without the user’s consent, nor provide such information to third parties beyond the scope necessary for providing the Services.
Chapter 6. Company Services and User Obligations
Article 21 (Transmission and Provision of Information)
  • ① The Company may provide members with various information related to the use of the Services through notices, email, or other methods when deemed necessary. However, members may opt out of receiving marketing emails at any time, except for transaction-related information, responses to customer inquiries, or other notices required under applicable laws and regulations.
  • ② If the Company intends to provide information described in Paragraph ① through telephone calls or facsimile transmission, the Company shall obtain the member’s prior consent.However, this shall not apply to transaction-related information, mandatory notices, or responses to customer inquiries.
Article 22 (Obligations of the Company)
  • ① The Company shall comply with applicable laws and regulations and shall not engage in acts prohibited by these Terms or contrary to public order and morality. The Company shall make reasonable efforts to provide stable and continuous Services in accordance with these Terms.
  • ② The Company shall maintain appropriate security systems to protect users’ personal information, including credit information, so that users may safely use the Services.
  • ③ If a user suffers damages due to false or misleading advertising conducted by the Company in violation of applicable laws regarding fair labeling and advertising of Travel Products, the Company shall be liable for such damages.
  • ④ The Company shall not send unsolicited commercial emails to users for marketing purposes.
Article 23 (Member Obligations Regarding IDs and Passwords)
  • ① Members are responsible for managing their IDs and passwords.
  • ② Members shall not allow third parties to use their IDs or passwords.
  • ③ If a member becomes aware that their ID or password has been stolen or is being used by a third party, the member shall immediately notify the Company and follow any instructions provided by the Company.
Article 24 (User Obligations)
  • ① Users shall not engage in any of the following acts:
    • 1. Registering false information when applying for or modifying account information
    • 2. Using another person’s information without authorization
    • 3. ChangesAltering information provided by the Company or posted on Monkeytravel
    • 4. Uploading or transmitting information, software, or materials other than those authorized by the Company
    • 5. Infringing the intellectual property rights, including copyrights, of the Company or third parties
    • 6. Damaging the reputation of the Company or third parties or interfering with their business operations
    • 7. Posting or transmitting obscene, violent, or otherwise inappropriate content contrary to public order and morality on Monkeytravel
  • ② If a user becomes aware that another user has engaged in any of the following acts, the user shall immediately notify the Company:Any prohibited acts described in Paragraph ①Any acts described in Article 26 Paragraph ③Any violations of these Terms.
  • ③ Users shall be deemed to have agreed in advance to cooperate with investigations conducted by the Company pursuant to Article 25 Paragraph ①.
Article 25 (Company Authority Regarding Suspected Violations)
  • ① The Company may investigate a user’s account or use of the Services in any of the following circumstances:
    • 1. If another user reports a violation to the Company pursuant to Article 24 Paragraph ②
    • 2. If the Company becomes aware that a user may have engaged in prohibited acts described in Article 24 Paragraph ①
  • ② If the Company determines through such investigation that the user has violated these Terms or breached obligations under these Terms, the Company may take actions against the user in accordance with Article 7 Paragraphs ② through ⑥.
Chapter 7. Copyright and Posts
Article 26 (Ownership of Copyright and Restrictions on Use)
  • ① Copyrights and other intellectual property rights related to works created by the Company shall belong to the Company.
  • ② Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes any information obtained through Monkeytravel that is subject to the intellectual property rights of the Company, nor allow any third party to use such information, without the Company’s prior consent
  • ③ If the Company uses copyrights licensed by users in accordance with these Terms, the Company shall notify the relevant user.
Article 27 (User Posts and Copyright)
  • ① “Posts” refer to any text, photos, files, links, reviews, comments, or other content uploaded or posted by members while using the Services.
  • ② TheMembers shall be solely responsible for any damages, disputes, or other issues arising from their posts, and the Company shall not be liable for such matters.
  • ③ TheThe Company may, without prior notice or consent from the member, suspend, modify, delete, move, or refuse registration of posts in any of the following cases:
    • 1. If the post seriously damages the reputation or dignity of another user or third party
    • 2. If the post contains content that violates public order or morality
    • 3. If the post promotes illegal copying, hacking, or other unlawful activities
    • 4. If the post infringes the intellectual property rights of a third party and a valid request for suspension or removal is received
    • 5. If the post is used for commercial advertising or promotional purposes
    • 6. If the post is objectively deemed to be related to criminal activity
    • 7. If the post infringes the rights, including copyrights, of other users or third parties
    • 8. If the post contains political or religious opinions unrelated to the nature of the Services provided by the Company
    • 9. If the post violates the Company’s posting policies or is inappropriate for the relevant board or service
    • 10. If the post otherwise violates applicable laws or regulations
  • ④ Copyrights to posts created by members shall belong to the relevant member.However, the Company may use such posts without separate compensation for purposes related to the operation, display, transmission, distribution, promotion, and improvement of the Services to the extent permitted under applicable copyright laws and fair business practices.
  • ⑤ If the Company intends to use a member’s post beyond the scope described in Paragraph ④, the Company shall obtain prior consent from the member through methods such as telephone, fax, or email.
  • ⑥ If a member terminates the service agreement, posts that have already been reposted, shared, incorporated into other posts, or posted on public bulletin boards may remain and may not be deleted.
Chapter 8. Liability and Dispute Resolution
Article 28 (Liability for Damages)
  • ① Since the Company provides intermediary and booking platform services for Travel Products through Monkeytravel, the Company shall bear responsibility to users only to the following extent:
    • 1. ResponsibilityResponsibility for information regarding Travel Products provided through Monkeytravel
    • 2. LiabilityResponsibility for damages incurred when a Travel Product booked by the user cannot be used due to reasons attributable to the Company, excluding cases attributable to the Travel Supplier
  • ② The Company’s liability under Paragraph ① shall be determined as follows:
    • 1. IfWhen determining whether the Company is liable for damages, the relevant facts and causal relationship shall be comprehensively considered.
    • 2. If the Company is liable for damages under Paragraph ① Subparagraph 2, the Company may provide alternative services or arrangements without prior notice depending on local circumstances. If the user agrees to or uses such alternative services, the Company shall be deemed to have fulfilled its obligation regarding compensation.
    • 3. TheThe Company’s liability for damages shall generally be limited to the booking amount paid for the relevant Travel Product. However, if the Company knew or could reasonably have known of special circumstances resulting in greater damages, the Company may be liable for such additional damages.
  • ③ The Company shall not be liable for any of the following:
    • 1. ThePerformance of contracts related to Travel Products, as well as accidents, damages, or risks arising from the use of such Travel Products, shall be the responsibility of the relevant Travel Supplier providing the product or service.
    • 2. TheThe Company does not guarantee the safety, accuracy, legality, or reliability of information or Travel Products not directly provided through Monkeytravel. Users are responsible for independently verifying detailed information, safety precautions, reliability, and other relevant matters directly with the relevant Travel Supplier. The Company shall not be liable for damages resulting from the user’s failure to do so.
    • 3. For affiliate products displayed on Monkeytravel, the affiliate provider shall bear full responsibility. The Company does not guarantee or assume any responsibility regarding such affiliate products.
    • 4. IfThe Company shall not be liable for damages caused by users’ unlawful use of Monkeytravel that results in harm to other users or third parties.
Article 29 (Dispute Resolution)
  • ① TheThe Company shall make reasonable efforts to promptly handle complaints and opinions submitted by users.
    However, if prompt handling is difficult, the Company shall notify the user of the reason and expected processing schedule without delay.
  • ② TheAny disputes arising between the Company and users may be resolved through mediation conducted by a dispute resolution agency designated by the Fair Trade Commission or other competent authorities under applicable laws.
Article 30 (Governing Law and Jurisdiction)
  • ① Any litigation arising from electronic commerce disputes between the Company and users shall be filed with the court having jurisdiction over the user’s address at the time of filing.
    If the user has no address, the competent court shall be determined based on the user’s residence.
    However, if the user’s address or residence is unclear, or if the user is a foreign resident, the lawsuit shall be filed with the competent court under the applicable civil procedure laws.
  • ② These Terms and any disputes arising between the Company and users shall be governed by and construed in accordance with the laws of the Republic of Korea.
Article 31 (Special Provisions)
  • ① These Terms shall be interpreted in accordance with applicable laws and regulations related to electronic commerce, electronic documents, electronic signatures, consumer protection, and other relevant laws.
  • ② Products subject to special conditions may be offered at discounted prices based on the application of cancellation fee policies or non-refundable conditions specific to each product.
    Cancellation policies and fees may vary depending on the Travel Product, accommodation provider, or Travel Supplier. Users are responsible for reviewing cancellation eligibility and applicable fees before completing a booking.
  • ③ These Terms shall apply equally to non-members using Monkeytravel, except for provisions that expressly apply only to members.
  • ④ If any provision of these Terms is found to be invalid or unenforceable under applicable laws, the remaining provisions shall remain valid and enforceable.
Supplementary Provisions
  • 1. These Terms shall take effect on December 26, 2018 (Notice Date: November 27, 2018).
  • 2. These Terms replace all previous versions of the Terms of Service.
